Registered Childcare is care that is regulated by the Scottish Commission for the Regulation of Care (the Care Commission). The Care Commission regulates care services using the National Care Standards and Regulations. These services must register with the Care Commission and will be subject to an annual inspection. Her Majesty’s Inspectorate of Education (HMIE) works with the Care Commission to provide an integrated system of regulation of pre-school education. If a care service operates for less than 2 hours per day, or for less than 6 days per year the care service will not be required to register. For childcare services, the relevant standards are Early Education and Childcare up to the age of 16, and Childcare Agencies. Unregistered childcare is any care which is not regulated by the Care Commission. Unregistered care may be subject to other statutory provisions such as The Protection of Children (Scotland) Act 2003 or employment law.

Unregistered childcare is care where parents remain responsible for their children throughout or operates for less than 2 hours a day and/or for less than 6 days a year.
Childcare Agencies can provide childcare in a child’s own home, through sitter services or nanny agencies, at times which fit parental needs such as in the evening or at weekends.
